Workers' compensation is a no-fault system, which essentially means that an employer has to pay benefits for an injury, if found to be compensable, regardless of who was at fault for the injury. The coverage is mandated by the Colorado Workers' Compensation Statute.
In order for a claim to be accepted, or considered compensable, the injury must meet certain criteria; such as, the injured employee must be an APS employee at the time of the injury, the injury must have occurred while in the course and scope of employment, and the injury must have been a direct result of the job.
If the claim is compensable, workers' compensation provides medical care and wage loss benefits for the employees. Medical care is provided at no cost to the employee. Wage loss benefits are calculated using the average weekly wage of what the employee was making at the time of the injury, and the employee will receive 66 and 2/3% of that average weekly wage, tax free.
